1.1 · Purpose of the site

Contraquerencia is an editorial project on bullfighting culture. Through this website the project's contents are presented and the subscription —free or paid— to the newsletter Último tercio, is managed, together with future editorial sections associated with the project.

1.2 · Intellectual and industrial property

The name Contraquerencia, the Cq identifier and the project's other distinctive signs are in the process of trademark protection before the Spanish Patent and Trademark Office. All texts, images, designs, logos and other contents published on this site are the property of the owner or of those who have legitimately assigned them for publication, and are protected by Spanish and international intellectual and industrial property law.

Their reproduction, distribution, public communication or transformation, in whole or in part, without the express written authorisation of the owner is prohibited, except for the uses permitted by the Intellectual Property Act. Brief quotations and direct links to the site are permitted provided they are correctly attributed.

1.3 · Liability

The owner endeavours to ensure that the published contents are truthful, current and accessible, but does not guarantee the absence of errors or the uninterrupted availability of the service. The owner is not responsible for the contents of external sites linked from Contraquerencia; links are informative in nature and do not imply endorsement of those contents.

1.4 · Applicable law and jurisdiction

The relationship between the owner and users is governed by Spanish law. For any dispute that may arise, the parties submit to the Courts and Tribunals of the city of Madrid, expressly waiving any other jurisdiction that might correspond to them.

2 · Privacy policy

This privacy policy explains how the personal data you provide when using this site are processed, in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

2.2 · What data we collect and for what purpose

We only collect the data strictly necessary for the purposes described below:

  • Newsletter subscription (free or paid): name and email address, in order to send you the issues of Último tercio and communications related to the project.
  • Email enquiries: the data you voluntarily include in your message, for the sole purpose of replying to you.
  • Technical browsing data: the site does not install analytics or advertising cookies; it may only use strictly necessary technical cookies for its operation (see section 3).
  • Consent (art. 6.1.a GDPR) for the newsletter subscription and associated commercial communications.
  • Performance of the contract (art. 6.1.b GDPR) for the provision of the paid subscription service, where enabled.
  • Legitimate interest (art. 6.1.f GDPR) for handling spontaneous enquiries sent by email.

2.4 · Retention period

Subscription data are kept for as long as you keep your subscription active. If you unsubscribe, we delete them within a reasonable period unless the law requires us to keep them (for example, tax obligations regarding payments received). Email enquiries are archived for the time necessary to handle them and, where appropriate, to document their management.

2.5 · Recipients of the data

Your personal data are not disclosed to third parties except where legally required. For sending emails and, in due course, for managing the collection of the paid subscription, processors recognised in the sector will be used, with whom the corresponding processing agreements will be signed under art. 28 GDPR (among others: newsletter delivery provider and payment gateway). This policy will be updated when they are effectively engaged.

2.6 · International transfers

Some of the envisaged processors may be located outside the European Economic Area. In that case, the safeguards required by the GDPR will apply (European Commission adequacy decisions, standard contractual clauses or binding corporate rules).

2.7 · Your rights

You may exercise the following rights at any time by writing to info@contraquerencia.com, attaching a copy of an identity document:

  • Right of access, rectification and erasure of your data.
  • Right to restriction of or objection to processing.
  • Right to data portability.
  • Right to withdraw the consent given at any time.
  • Right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) if you consider that the processing does not comply with the regulations.

2.8 · Security

We apply reasonable technical and organisational measures to protect your data, in accordance with the state of the art and the type of information processed. In the event of an incident with significant impact, we will act in accordance with arts. 33 and 34 GDPR.

Cookies are small text files that websites may store in your browser. This policy explains which cookies are used on contraquerencia.com and how you can manage them, in accordance with art. 22.2 LSSI-CE and the guidelines of the Spanish Data Protection Agency.

3.1 · Cookies we use

In its current version, this site does not install analytics, profiling or advertising cookies. Only strictly necessary technical and session cookies may be used to ensure the correct functioning of the site and which, under art. 22.2 LSSI-CE, do not require prior consent.

If analytics cookies (for example, to measure visits in an aggregated and anonymous way) or third-party cookies (newsletter provider, payment gateway) are added in the future, this policy will be updated and, where appropriate, a consent banner will be activated in accordance with the regulations in force.
